The Kuala Lumpur High Court ordered the company to be wound up, appointed a private liquidator and awarded RM7,000 in costs against it.

KUALA LUMPUR: The High Court has ordered the winding-up of a construction company over an RM8.27 million judgment debt owed to Seremban Specialist Hospital Sdn Bhd.

Judicial Commissioner Ku Hayati Ku Haron said One-Builtwell Associates (M) Sdn Bhd could not rely on a pending appeal to stop winding-up proceedings unless it had obtained a stay of execution.

“A pending appeal, standing alone and unsupported by a stay, does not transform a valid and enforceable judgment debt into a bona fide disputed debt,” she said in her ruling.

The debt arose from a Seremban High Court judgment in November last year, which ordered One-Builtwell to pay RM8,267,780 together with 5% annual interest and RM30,000 in costs.
