The Court of Appeal said there was no overt act connecting the accused to the alleged trafficking, noting that fingerprints and CCTV recordings were also absent.

PUTRAJAYA: A night market wholesaler walked free today after the Court of Appeal overturned his convictions for two drug trafficking offences, each carrying a 30-year prison sentence.

Lum Man Liong, 59, had been in custody since his arrest in February 2021 and had been serving his sentence after being convicted.

A three-member bench, comprising Choo Kah Sing, Nadzarin Wok Nordin and K Muniandy, said the convictions were unsafe as the trial judge had dismissed Lum’s defence without sufficiently evaluating the evidence.

Muniandy, who delivered the broad grounds of judgment, said the prosecution failed to prove the element of knowledge necessary to establish possession of the drugs.
