The Federal Court found no basis to invalidate the regulations invoked, saying Azizul Abd Wahab was given an opportunity to make written representations.PUTRAJAYA: Police officers have no statutory right to appeal disciplinary punishments before a disciplinary appeal board, the Federal Court ruled today, holding that the exclusion does not violate constitutional guarantees of equality.
Justice Vazeer Alam Mydin Meera said Article 8(1) of the Federal Constitution does not require identical treatment for public officers whose circumstances and responsibilities differ.
"The absence of a statutory appeal, taken by itself, does not establish unconstitutional discrimination where the relevant classification is justified and the disciplinary process remains subject to legal safeguards," he said.
