The High Court upheld an Industrial Court award against AirAsia which ruled that a 75% salary cut during the Covid-19 pandemic was tantamount to constructive dismissal.KUALA LUMPUR: The High Court has dismissed AirAsia's bid to overturn an Industrial Court award of RM268,620 in compensation and back wages to a former pilot who successfully claimed constructive dismissal.

Justice Azizan Arshad upheld the Industrial Court's 2024 decision in favour of Eric Koh, ruling there was no basis for appellate intervention in the case.

"This court finds that the appellant (AirAsia) failed to establish any material error of law or fact in the tribunal's decision.

"The chairman correctly identified the central issue, namely whether the respondent (Koh) was constructively dismissed as a consequence of the company's conduct and whether that conduct amounted to a fundamental breach of the employment contract," he said.
