KUALA LUMPUR, Nov 5 — Embattled Malaysian Border Control and Protection Agency (MBCA) director-general Datuk Seri Mohd Shuhaily Mohd Zain has yet to receive an official transfer letter from the Home Ministry, leaving him legally empowered to lead the agency despite ministerial statements that he is being returned to the police force.

Counsel Muhammad Rafique Rashid Ali confirmed that in the absence of a formal administrative directive, his client remains fully authorised to execute his duties at the helm of the national border agency, FMT reported.

“To date, he has not been found guilty of any offence. He can therefore continue to carry out his duties as usual,” he said when met at the court complex here.
