KUALA LUMPUR: The High Court ruled a teenager born in China to a Malaysian father a citizen, by operation of law from birth, despite finding that his parents' marriage was legally void.
Judge Sumathi Murugiah ruled that the teenager was deemed the legitimate child of his parents under Section 75(2) of the Law Reform (Marriage and Divorce) Act 1976.
She ordered the National Registration Department (NRD) to process and issue him a MyKad, recording him as a Malaysian citizen, subject to the usual administrative requirements for photographs, biometrics and collection.
The teenager was born in Shenzhen, China, on Feb 18, 2009, to a Malaysian father and a Chinese mother.
His parents had gone through a marriage ceremony in 2007 and were issued an official marriage certificate by NRD.
