(File pic)PETALING JAYA: The Court of Appeal has upheld a 27-month prison sentence imposed on a former waiter for violating the conditions of a restriction order which required him to remain indoors between 8pm and 6am.

A three-member bench dismissed Kee Wen Wei's appeal on Oct 30, Bernama reported.

In the grounds of judgment posted today, Justice Noorin Badaruddin, who headed the bench, said Kee had failed to establish that the supervision order was automatically invalidated by a Federal Court decision that declared a section of the Prevention of Crime Act as being unconstitutional.

Kee had been placed under supervision from March 4, 2020, to March 3, 2022, during which he was required to reside within the Hulu Kinta sub-district in Perak and placed under an 8pm-6am curfew for involvement in car theft.
